Data Protection Clarification Text

This Clarification Text (hereinafter referred to as the "Text") has been prepared by Was Construction Industry and Trade Joint Stock Company as the data controller in accordance with the Law No. 6698 on the Protection of Personal Data ("KVKK") to transparently inform you about the methods of collecting personal data, the purposes and legal grounds for data processing activities, principles regarding the transfer of personal data if applicable, and your rights as the data subject regarding personal data obtained from Personal Data Owners and/or third parties through the www.sech-ven.com.tr website (hereinafter referred to as the “site”).

In accordance with KVKK, the Personal Data you share as a personal data owner may be collected and processed by the Company, which is designated as the Data Controller, within the scope specified below.

1. DEFINITIONS AND ABBREVIATIONS

In this Text:

  • Company refers to Sech-ven S.L. Joint Stock Company at  Poligono Industrial Nueva Campana, Nave No:7, 29660, Nueva Andalucia, Marbella / Malaga.

  • Personal Data refers to any information relating to an identified or identifiable natural person.

  • Processing of Personal Data includes any activity performed on data, such as obtaining, recording, storing, retaining, modifying, reorganizing, disclosing, transferring, taking over, making accessible, classifying, or preventing the use of personal data.

  • Personal Data Owner means the natural person whose personal data is processed.

  • KVKK means the Law on the Protection of Personal Data No. 6698, published in the Official Gazette on April 7, 2016.

  • Data Processor means the natural or legal person who processes Personal Data on behalf of the Data Controller based on the authority granted by the Data Controller.

  • Data Controller means the natural or legal person who determines the purposes and means of processing Personal Data and is responsible for establishing and managing the data registry system.

  • Website/Site refers to www.sech-ven.com.tr.

2. PROCESSED PERSONAL DATA

Depending on the nature of your relationship with the Company, the types and numbers of personal data collected may vary based on the purpose of processing. Personal Data you share with the Company or obtained from third parties by the Company include:

Your personal data is processed in compliance with the general principles established under Article 4 of KVKK, which mandates that personal data be processed in accordance with law and integrity principles, accurately and, where necessary, updated, for specific, explicit, and legitimate purposes, and in a manner relevant, limited, and proportionate to the purposes for which they are processed and stored for the period required by relevant legislation or for the purpose they are processed for.

Personal data may not be processed without the explicit consent of the Personal Data Owner as per Article 5 of KVKK. However, personal data can be processed without the explicit consent of the Data Subject if one of the following conditions is met:

  • It is expressly provided for by law;

  • It is mandatory for the protection of life or physical integrity of the person or another person who is unable to disclose their consent due to physical impossibility or whose consent is legally invalid;

  • It is directly related to the establishment or execution of a contract, provided that it is necessary to process the personal data of the parties;

  • It is mandatory for the Data Controller to fulfill its legal obligation;

  • The personal data has been made public by the Data Owner;

  • Data processing is mandatory for the establishment, exercise, or protection of a right;

  • Processing is mandatory for the legitimate interests of the Data Controller, provided it does not harm the fundamental rights and freedoms of the Data Owner.

3. GENERAL PRINCIPLES, CONDITIONS, AND PURPOSES FOR THE PROCESSING OF PERSONAL DATA

Your personal data is processed in line with the general principles set forth under Article 4 of KVKK, based on certain, clear, and lawful objectives and preserved for the duration required by relevant legislation or necessary for the purpose for which they are processed.

Personal data processing activities, without requiring explicit consent, may be conducted based on the following legal grounds specified under Article 5 of KVKK:

  • Expressly provided by laws;

  • Necessary for the establishment, protection, or exercise of a right;

  • Legitimate interest of the Data Controller without damaging the fundamental rights and freedoms of the Data Owner.

4. METHODS AND LEGAL GROUNDS FOR COLLECTING PERSONAL DATA

Your Personal Data may be collected by the Company through various channels such as www.sech-ven.com.tr, email, call center, store, camera, and mobile application in accordance with the basic principles stipulated by KVKK, and under the conditions of data processing specified in Articles 5 and 6 of KVKK, as indicated in this Text.

5. TRANSFER OF PERSONAL DATA, PURPOSES, AND DURATION OF TRANSFER

6. DATA SECURITY

The Company takes appropriate measures consistent with the relevant privacy and data security laws and regulations to protect your Personal Data from unauthorized access, destruction, alteration, and unauthorized disclosure, implementing technical and institutional safeguards as necessary.

7. RIGHTS AND OBLIGATIONS OF THE DATA SUBJECT

Data subjects are responsible for the accuracy, completeness, and currency of the Personal Data they share with the Company and for obtaining consent from others if sharing third-party data with the Company. Data subjects have the following rights under KVKK:

  • To learn whether their personal data is processed;

  • To request information if their personal data has been processed;

  • To learn the purposes of processing personal data and whether it is used for its purpose;

  • To learn about third parties to whom personal data has been transferred domestically or abroad;

  • To request the correction of personal data in case of incomplete or incorrect processing and to request notification of third parties to whom personal data is transferred;

  • To request the deletion or destruction of personal data within the framework of the conditions set forth in KVKK.
